Please read the following terms and conditions carefully before using the Pelican741 gaming centre (“Service”). By using the Service, you agree to be bound by these terms and conditions (“Terms”). If you do not agree to these Terms, do not use the Service.
Service Use
You may use the Pelican741 Service only if you accept the Terms and the Privacy Policy provided on the Pelican741 App and/or Website. Pelican741 reserves the right to change the Terms at any time without prior notice. Your continued use of the Service after any changes to the Terms will constitute your acceptance of the modified Terms.
Booking
When you order a game console from the Pelican741 App and/or Website, you acknowledge that the contract for the supply of the Pelican741 Service is between you and Pelican741. You agree to provide accurate and complete details when ordering and warrant that the credit or debit card information you provide is your own.
You understand that some games may be suitable only for certain age ranges and it is your responsibility to check whether the game you are playing is suitable for the intended recipient.
Prices and Payment
All prices listed on the Pelican741 App and/or Website for gaming console rental are correct at the time of publication, but the final price charged may change at the time of delivery based on the latest menu and prices. Pelican741 reserves the right to alter the list of games available for sale on the Pelican741 App and/or Website and the prices of gaming console options.
If there is a change in price, Pelican741 will make every effort to inform you immediately after you book your order. You agree that Pelican741 or its employees will not be liable for any price changes.
The total price, including all other charges, taxes, and costs, will be displayed on the Pelican741 App and/or Website when you place your order. Full payment must be made for all items in your order.
If you choose online payment, you must ensure that the payment mode is secured, and your debit/credit card details are encrypted to prevent unauthorised access. Your credit card company may also conduct security checks before making any payment.
If you cancel your pre-booked slot, 10% of the cancellation charges of the total order value will be deducted from the total value, and the refund will be processed within 7 working days. No refund will be issued for cancellation after time slot which you booked for. If you encounter any issues, please report them to “support@pelican741.com“.
For cash orders, the full amount must be paid at the beginning of the rental period.
Offers, Discounts and Cashback
Offers, discounts, and cashback programs such as “Cashback” and “Referral Bonus” are valid for a limited period only, as decided by Pelican741. After the expiry of this limited period, no cashback can be claimed for recharge or referral bonus.
Pelican741 reserves the right to change the terms, conditions, and validity period of offers and discounts at any time without notice.
Service
Please note that Pelican741 does not offer delivery service for game console rentals. Any delays or failures in accessing the game console on site due to events beyond Pelican741’s control, such as power outages or technical difficulties, shall not hold Pelican741 liable. In the event of any cancellation by Pelican741 due to inability to provide the game console on site, the rental fee will be refunded to the original payment method within 7 working days. Pelican741’s maximum liability for any default or delay in providing the game console rental shall not exceed the corresponding rental fee. Any costs incurred by Pelican741 in excess of this amount shall be indemnified by the customer.
PERSONAL INFORMATION AND PRIVACY
You understand and acknowledge that by choosing Pelican741, you have allowed Pelican741 to use your personal information. You understand, acknowledge, and agree that although Pelican741 provides appropriate firewalls and protections, the Pelican741 Service is not hack-proof. Data pilferage due to unauthorized hacking, virus attacks, technical issues is possible. OWNERSHIP OF INTELLECTUAL PROPERTY
All intellectual property rights of Pelican741, including but not limited to copyright, logos, names, trademarks, service marks, design, text, sound recordings, images, links, concepts, and themes are exclusively owned by Pelican741 or its licensors. Any reproduction, transmission, publication, performance, broadcast, alteration, license, hyperlink, creation of derivative works or other use in whole or in part in any manner without the prior written consent of Pelican741 or its licensors is strictly prohibited.
You acknowledge and agree that any feedback, suggestions, ideas, or other information or materials regarding Pelican741 or its services that you provide, whether by email, posting through the Services or otherwise, are not confidential and shall become the sole property of Pelican741. Pelican741 shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these materials for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
